[OH] Fired for wife attack, Officer Martzolf gets his job back

..."We don't blame the township for disciplining him but we believe that justice has been served... I believe that the arbitrator felt that given his years of service he deserved a second chance"...

BEACH CITY, OH - A Jackson Township police officer fired last year for allegedly assaulting his wife can return to work, an arbitrator has ruled. The ruling, which was issued this week, states officer Eric Martzolf must be reinstated to the force within seven days, said Mike Piotrowski, general counsel for the Fraternal Order of Police/ Ohio Labor Council. Martzolf, a 13-year veteran, is ineligible for back pay but will be restored to his former position with his seniority rights intact. The arbitrator's decision includes a last chance agreement, under which Martzolf can be automatically dismissed for any future disciplinary incidents, Piotrowski said. "We're obviously happy with the results," Piotrowski said. "We don't blame the township for disciplining him but we believe that justice has been served... I believe that the arbitrator felt that given his years of service he deserved a second chance"...The township fired Martzolf for conduct unbecoming an officer last October. Martzoff was charged with domestic violence after he allegedly struck his wife at her place of employment on Aug. 28, 2007... Martzolf filed a grievance through the union three days after the firing. Martzoff later pleaded no contest to a lesser charge of disorderly conduct in Massillon Municipal Court. Martzolf was found guilty and sentenced to 30 days in jail. All but two days of the jail term were suspended on the condition that Martzoff commit no related offenses for two years and comply with all probation and court orders... [Full article here]
